1. Parties and job details

Agreement documents. This Service Agreement, the accepted quote or booking confirmation, any signed or electronically accepted change order, and the Completion & Item Release Record form the complete agreement for this job. If they conflict, the later signed change order controls only for the changed work or price.

2. Selected services and price

Only checked and described work is authorized. A quoted add-on is not included unless it appears in the accepted price below or in a later written change order.

3. Services and change approval

Garage Hero will use reasonable care to perform the selected services at the service property. Cleanout and organizing work does not include restoration, painting, electrical work, plumbing, structural work, pest treatment, mould or asbestos remediation, or any service not written above.

The quote is based on the information, photographs, access, volume, condition, and item types provided by the customer. If site conditions or the amount or type of material materially differs, Garage Hero may pause and provide a revised tier, scope, schedule, or price. No additional work or charge proceeds until the customer or authorized representative approves it in writing or electronically.

Garage Hero may use employees or subcontractors under its direction to perform the work.

4. Customer authority and instructions

The customer confirms that they own the property to be removed or have the legal authority of the owner to direct its handling. The customer will identify third-party, rented, leased, financed, sentimental, valuable, confidential, or irreplaceable items before work begins.

Garage Hero will rely on the customer’s sorting instructions. Items not clearly approved for removal will stay at the property. The customer is responsible for resolving disagreements among owners, occupants, family members, tenants, landlords, estates, or other interested persons before removal.

5. Access and site preparation

The customer will provide lawful access at the agreed time, a reasonably safe work area, and clear instructions about gates, alarms, parking, elevators, loading restrictions, and property rules. Children, pets, and bystanders must remain away from active work areas.

The customer will remove cash, jewelry, medication, identity documents, keys, electronic data, firearms, ammunition, and other valuables before work. Garage Hero may stop or postpone work if access or conditions are unsafe, unlawful, or materially different from what was disclosed.

6. Excluded and hazardous materials

Unless Garage Hero agrees in writing and has a lawful disposal route, the service excludes asbestos-containing or suspected asbestos materials, mould remediation, human or animal waste, needles and medical waste, explosives, ammunition, firearms, propane or other compressed-gas cylinders, fuel, unknown chemicals, pesticides, solvents, wet paint, controlled substances, and leaking or unidentified containers.

The customer must disclose known contamination, infestations, sharp objects, structural instability, and other hazards. Garage Hero may isolate an item, stop work, or require a qualified specialist. Any separately approved hazardous or regulated disposal charge requires customer approval before it is incurred.

7. Super Scrub and shelving conditions

If Super Scrub is selected, the customer will provide a working outdoor water tap and a safe, functioning pressure washer unless the quote states otherwise. Garage Hero does not promise removal of every oil mark, rust mark, stain, odour, coating defect, or discolouration. The area may remain wet and slippery after service.

Basic shelving installation is limited to assembly and ordinary anchoring at customer-approved locations. It excludes electrical, plumbing, structural alteration, engineering, and repair of defective walls or floors. The customer will disclose known concealed utilities or hazards. Garage Hero may decline an installation location that appears unsafe or unsuitable.

8. Customer-directed removal, donation, disposal, and resale

The customer keeps control of all disposition decisions. Garage Hero will not treat an item as abandoned merely because it is in the work area. The customer must specifically approve items or clearly defined groups of items for removal.

After the main service is finished, Garage Hero may ask whether the customer wants any remaining unwanted items removed at no additional purchase price. The customer is free to keep or sell those items independently. There is no obligation to surrender anything.

When Garage Hero accepts an item listed or clearly described in the Completion & Item Release Record, ownership transfers to Garage Hero free and clear of liens and third-party claims. Garage Hero may then reuse, donate, recycle, discard, or resell it at its discretion. Unless a separate written purchase or consignment agreement says otherwise, the customer receives no sale proceeds, credit, or later accounting.

Garage Hero may refuse any item. The customer remains responsible for items not accepted, items prohibited by law or facility rules, and personal data left on devices or documents.

9. Price, payment, and change orders

The 25% deposit is credited to the total price. The balance and any customer-approved change order are due as shown in Section 2. Garage Hero may issue the balance invoice electronically. Applicable taxes are added as required.

If disposal fees are not marked “included,” Garage Hero will obtain approval for additional tipping or special-handling charges before incurring them, except where an immediate safety response is reasonably necessary. Receipts will be provided for at-cost disposal or products on request.

Garage Hero may suspend work for non-payment of an undisputed amount. The customer may raise a good-faith billing concern without waiving the obligation to pay the undisputed portion.

10. Cancellation, no-show, and delays

The customer may cancel or reschedule by email or another written channel accepted by Garage Hero. A cancellation or no-show less than 24 hours before the scheduled start time forfeits the 25% booking deposit, except where applicable law requires otherwise. For an earlier cancellation, the deposit will be refunded unless a clearly disclosed, customer-approved non-refundable special-order cost has already been incurred.

If Garage Hero cancels and cannot offer an acceptable new date, Garage Hero will refund amounts paid for unperformed work. Neither party is responsible for delay caused by unsafe weather, facility closure, illness, vehicle failure, utility interruption, emergency, or another event reasonably beyond its control; the parties will try to reschedule.

Customer Waiver + Risk Acknowledgement

11. Known and inherent service risks

The customer understands that cleanout, moving, hauling, pressure washing, and shelving work can involve heavy, awkward, sharp, dusty, wet, dirty, fragile, or unstable items. Even when reasonable care is used, ordinary risks can include dust, noise, temporary blocked access, wet or slippery surfaces, minor scuffs, pre-existing finishes becoming visible, movement of loosely installed objects, and disturbance of hidden pests or deteriorated material.

The customer accepts these ordinary and inherent risks to the extent they are not caused by Garage Hero’s failure to use reasonable care. The customer will warn Garage Hero about fragile finishes, weak structures, hidden hazards, and items requiring special handling.

12. Release and limits that remain fair

To the extent permitted by law, the customer releases Garage Hero and its workers from claims arising only from ordinary and inherent risks described in Section 11 that are not caused by their negligence or wilful misconduct.

Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited. This waiver does not release Garage Hero from liability for its negligence, gross negligence, fraud, or wilful misconduct. It also does not remove any non-waivable consumer right or remedy.

To the extent permitted by law, Garage Hero is not responsible for indirect or consequential loss, lost profits, loss of use, or sentimental value. This sentence does not limit a claim for direct physical damage or personal injury caused by Garage Hero’s negligence.

13. Pre-existing conditions and damage reporting

Garage Hero is not responsible for damage that existed before the service, ordinary deterioration, hidden defects, improperly installed fixtures, overloaded or unstable shelving, or failure of customer-supplied equipment unless Garage Hero’s negligence caused additional damage.

The customer should inspect the work area with Garage Hero at completion and report any concern as soon as reasonably possible, preferably within 48 hours, with photographs if available. Except in an emergency, the customer will give Garage Hero a reasonable opportunity to inspect and propose repair, replacement, or another resolution before arranging third-party work.

14. Customer responsibility for authority and disclosure

The customer is responsible for reasonable losses and third-party claims caused by the customer’s false statement that they owned or were authorized to surrender an item, or by the customer’s knowing failure to disclose a serious site hazard. This does not apply to loss caused by Garage Hero’s negligence or wilful misconduct.

15. Privacy and photographs

Garage Hero may collect contact details, service instructions, site photographs, payment status, and disposal records as reasonably needed to quote, schedule, perform, document, and support the service. Garage Hero will not use identifiable customer or property images for advertising without the separate consent below, and will take reasonable steps to avoid photographing sensitive personal information.

Operational photos (required when reasonably needed): The customer authorizes before-and-after and condition photographs for quoting, job documentation, damage review, and internal training. These photos are not public marketing consent.

Optional marketing consent (choose one): □ YES □ NO Garage Hero may use non-identifying before-and-after images from this job in its website, social media, portfolio, and advertising. Garage Hero will not publish the customer’s name, address, faces, licence plates, or personal documents without separate written permission.

16. Questions, complaints, and governing law

The customer should send questions, cancellations, billing concerns, or damage notices to garageherohfx@gmail.com and include the booking reference. Both parties will first try in good faith to resolve a concern directly. This does not prevent either party from using any court, regulator, insurer, or other remedy available by law.

This Agreement is governed by the laws of Nova Scotia and the federal laws of Canada that apply there. If a provision is unenforceable, the remaining provisions continue. A waiver of one breach is not a waiver of another. Electronic signatures and counterparts are accepted.

17. Customer acceptance

The customer confirms that they received or had access to this Agreement before accepting the booking, reviewed the scope and price, understand the cancellation rule and item-transfer terms, and are authorized to enter this Agreement.

When you book online, checking the acceptance box records your agreement to this version of the Service Agreement. A copy is available by email on request, and the Completion and Item Release Record is signed at the property after the service.

Completion and Item Release Record

Completed at the property after the main service is finished. You inspect the work with the crew, note anything incomplete or any concern, and confirm the final balance.

After the service, you may choose to release unwanted items to Garage Hero. Only items you freely list or clearly describe are transferred to us. You can keep, gift, or sell anything yourself: there is no obligation to surrender anything. Both you (or your authorized representative) and the Garage Hero lead sign the record.
